Terms & Conditions

​1. Service Agreement

By subscribing to the Evolution Plan or any of our services, you gain access to a comprehensive suite of offerings, including but not limited to:

​

• Website Design & Management

• Search Engine Optimization (SEO)

• Marketing Strategy & Support

• Business Coaching

• Social Media Management

• Mass Email Campaigns & Contact Management

• Platform Analytics & Data Reviews

• Advertising Management (Note: Advertising budgets are separate and not included)

 

Services are available on a monthly, quarterly, or annual basis at agreed-upon rates. Specific deliverables and timelines will be outlined in your individual service agreement.

2. Payment Terms

Payments are processed automatically at the start of each billing cycle using your chosen payment method. In the event of a declined or returned payment, a fee of $70 will be applied to your account. Continued non-payment may result in suspension or termination of services.

3. Cancellation Policy

You may cancel your subscription at any time by providing a 30-day written notice. For quarterly and annual subscribers, a prorated refund will be calculated based on the remaining term. Upon cancellation, services will continue until the end of the current billing cycle.

4. Intellectual Property Rights

All materials and assets created by Benji Does during the course of our engagement are considered "work for hire." Upon full payment, you receive full ownership rights to these materials. Benji Does retains the right to showcase completed work in our portfolio and promotional materials, unless otherwise agreed upon in writing.

5. Scope of Services

Our services are defined in your individual agreement. Any requests beyond the outlined scope may incur additional fees, which will be communicated and agreed upon prior to commencement. Additional costs may include, but are not limited to, third-party platform fees, hosting services, advertising budgets, and specialized software licenses.

6. Client Responsibilities

To ensure the success of our collaboration, clients are expected to:

• Provide timely feedback and approvals

• Supply necessary content and materials

• Communicate any changes in project scope promptly

Delays in client responses may affect project timelines and deliverables.

7. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information and not disclose any confidential materials to third parties without prior written consent, except as required by law.

8. Limitation of Liability

Benji Does shall not be held liable for any indirect, incidental, or consequential damages arising out of or related to our services. Our total liability shall not exceed the total amount paid by the client for the services rendered.

9. Governing Law

These terms and conditions are governed by the laws of the State of Arizona. Any disputes arising under these terms shall be resolved in the courts located in Maricopa County, Arizona.

10. Amendments

Benji Does reserves the right to modify these terms and conditions at any time. Clients will be notified of significant changes, and continued use of our services constitutes acceptance of the updated terms.​
